Terms of Service and User Agreement

This is a plain-English summary of the most important rules for using our website, Liquidation Pallets Sales. It is not a replacement for the full legal agreement but highlights key points you need to know. By registering on our site, you agree to these terms.

1. Our Role

  • We are an online marketplace that connects sellers of liquidation merchandise (returns, surplus, pallets) with buyers.

  • We provide the platform, logistics support, payment processing, and customer service. We are not a traditional broker or agent and are generally not a party to the actual sale between buyers and sellers.

2. Your Account & Responsibilities

  • Registration: You must provide accurate information to register. You are responsible for keeping your login credentials secure and for all activities under your account.

  • Eligibility: You must be legally able to enter into a binding contract.

  • Conduct: You agree not to interfere with the website, use it for illegal activities, or misuse other users' confidential information.

3. Key Buyer Obligations

  • "As-Is" Sales: All items are sold "as-is, where-is" with all faults. We make no warranties about the condition, quality, or functionality of the merchandise.

  • Binding Bids/Purchases: Bidding, making a "Best Offer," or using "Buy Now" is a legally binding commitment to purchase the item.

  • Payment: Full payment is due immediately after a purchase is won or made. Your account will be suspended if payment is not received within one business day.

  • Shipping & Pickup: You are responsible for all shipping costs. You must arrange pickup or shipping within 14 days of payment. Failure to do so may result in order cancellation and a 10% restocking fee.

  • Inspection: If you arrange your own shipping, you waive the right to claim damages for issues visible at pickup. It is your responsibility to inspect the goods upon receipt.

  • Demanufacturing & Resale: Before reselling any items, you must permanently remove or deface all manufacturer/retailer logos, tags, and barcodes. You must also digitally wipe all devices that store personal data to U.S. government standards.

4. Key Seller Obligations

  • Accurate Listings: You are solely responsible for providing accurate and complete descriptions, quantities, and images of your merchandise.

  • Legal Ownership: You must have clear, marketable title to all items you list and the authority to sell them.

  • Fulfillment: You must pack and ship sold items within 72 hours of receiving payment. Delays may result in you being charged for associated costs.

  • No Shill Bidding: artificially bidding on your own auctions to inflate the price is strictly forbidden and may lead to account termination and legal prosecution.

  • Fees: We charge a 10% transaction fee on the final sale price of successfully sold items.

5. Fees & Payments

  • All transactions are in U.S. Dollars.

  • Our fee for successful sales is typically 10% of the sale price.

  • Approved payment methods include wire transfer and credit card.

6. Dispute Resolution

  • If you have an issue with a purchase (e.g., quantity or condition differs from the listing), you must file a formal dispute by emailing our support team with supporting evidence (photos, manifest).

  • If we cannot resolve the dispute, the matter may be settled by binding arbitration in Miami, Florida.

7. Important Legal Points

  • No Circumvention: You agree not to contact other users directly to complete a sale outside of our website. If you do, you may owe us a 15% success fee.

  • Limitation of Liability: To the fullest extent permitted by law, Liquidation Pallets Sales will not be liable for any indirect, special, or consequential damages arising from your use of the site. Our total liability for any claim is limited to the fees you paid to us for the disputed item(s).

  • Indemnification: You agree to cover any legal costs or damages we incur because of your misuse of the site or breach of this agreement.

  • Governing Law: This agreement is governed by the laws of the State of Florida.

8. Changes & Termination

  • We can change these terms and will provide 30 days' notice. Your continued use of the site means you accept the changes.

  • We or you may terminate this agreement at any time. We reserve the right to suspend or terminate accounts for any reason, including violations of these terms.
